By accessing our website, purchasing marketing packages, or engaging Kultiva Marketing Agency for web design, hosting, Google Business Profile management, or paid advertising, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.
Kultiva Marketing Agency provides digital growth services for trade contractors as specified in your selected package or service agreement. Clients are responsible for providing timely access to necessary business accounts, domain registrars, content assets, and brand information required for campaign setup and website builds.
All recurring monthly retainer fees, managed hosting fees, and ad management packages are billed in advance on a month-to-month basis. We do not require long-term lock-in contracts. Cancellations require a 30-day written notice sent to legal@kultivaagency.com.au prior to your next billing cycle.
Upon full settlement of all outstanding invoices, clients retain full ownership of custom website design files, domain names, copywriting, and custom graphics created specifically for their business. Kultiva Marketing Agency retains ownership of proprietary code frameworks, agency tools, and pre-existing design templates.
We offer a 99.9% uptime SLA for managed cloud web hosting. Scheduled maintenance windows are performed during low-traffic hours and communicated in advance. Kultiva is not liable for temporary service interruptions caused by third-party infrastructure providers or external DNS outages.
Kultiva Marketing Agency makes every effort to optimize campaigns and local search rankings; however, third-party search engine algorithms (such as Google Maps) and ad platform policies are beyond our direct control. In no event shall Kultiva Marketing Agency be liable for indirect, incidental, or consequential damages arising from campaign performance.
